Primary requirements

The main condition — availability of evidence of the import of counterfeit goods. If they are missing, inclusion in the TRIIS is impossible. Peculiarities:

• Notarization of copies — If the documents are not in Russian, translation is required.
• In in accordance with the regulations, the period for consideration of an application in TROIS is 2 months — may take up to 4 months.
• The maximum period for intellectual property objects to remain in the customs register is 2 years, after which it can be extended as many times as needed.
• Entry into the TROIS is not subject to duty.

Documents for registration in TROIS

The main stage of preparation for submitting an application for entry into the customs register — collection of documents. There is no exhaustive list; the package is formed depending on the specifics of the intellectual property object:

• Information about the copyright holder, confirmation of valid status.
• Data about authorized representatives who can represent his interests in state bodies and customs.
• Certificate of registration of a trademark (certified copy), certificate from FIPS (WIPO). You may need information about issued licenses for its use, information about alienation.
• Description of the original product on which the trademark is applied. Additionally, you should provide information about persons who are granted the right to conduct trade turnover (import, sale).
• List of customs posts where goods are cleared.
• Data about counterfeit products (list, documents that indicate transportation), violators.
• Insurance policy (from 300 000 rubles) — for property liability insurance.

Main stages of entering into the TRIIS

1. Consultation. Preliminary forecast. Preparation of a cooperation agreement. Clarification of client rights, discussion of deadlines
2. Drawing up an application for the protection of intellectual rights. Systematization of facts of illegal import/export. Collection of documentation package. Registration of an insurance policy. This stage takes up to 1–2 days, in rare cases — up to 3–5 days.
3. Submission of documents, correspondence with the Federal Customs Service, preparation of additional documentation at the request of customs authorities, explanations in accordance with the requirements. The process can take up to 60 days, sometimes longer.
4. Entering into TROIS with subsequent publication of information about the object of intellectual rights on the official website of the Federal Customs Service.
