What is the marking of shoes for when importing

When finished products are imported into Russia, according to the law they are labeled to control turnover and protect consumers from counterfeit. At the same time, Data Matrix codes are used, which are sent to the information system «An Honest Sign». In accordance with the codes, the system records information about the product, such as:

product name

manufacturer country

information about the manufacturer, including its addressspan>

brand name

information about the importer

characteristics of shoes, etc.

 

Mandatory labeling of shoes imported and manufactured in Russia was created to protect consumers from dangerous and counterfeit products. Shoe marking functions:

When did the marking of shoes begin to take effect?

Various goods, including shoes, are subject to labeling. It is marked without fail from June 1, 2021. The labeling rules apply to shoes made of various materials: rubber, plastic, textile, leather, wooden, sports, leatherette, protective, waterproof.

Who performs the labeling of goods when imported into Russia

Only a person registered in the territory of the Russian Federation can label products. That is, a buyer, importer or manufacturer with a branch in Russia. Moreover, it is necessary to physically mark the goods before they cross the border. In most cases, the buyer marks the shoes. How to label imported goods

It is necessary to label the product before it crosses the border, or at the customs warehouse.

Procedure for actions if the products are marked for the first time:

Step 1. Order the date matrix in an «Honest Sign».

Register with the «Honest Sign» and request the release of shoe marking codes. Specify for what purpose — for the import of products. It is possible to register in the IC CHZ only with the CAP.

Step 2. Register in GS1 RUS.

Codes are ordered with a GTIN received by the importer (a legal entity or sole proprietor registered in Russia) in GS1 RUS.

For the purpose of registration, the Russian importing company, which is listed in the CZ, poisons GTIN in GS1 RUS and describes shoes. GTIN a day after being sent to GS1 RUS enters the CHZ and becomes available to the importer as the basis for ordering the date matrix.

Step 3. Apply marking codes

The manufacturer, buyer or importer must apply the marking codes before crossing the border or at the customs warehouse. If you are unable to apply the marking codes yourself, contact a specialized company, for example, ATC C&L.

The procedure for applying marking codes is controlled by Government Decree No. 1956. Here are the key points:

• The identification means is applied to shoes, packaging, label or label in a way that does not allow the separation of the identification means.
• If you sell a set of goods, for example, a suit, then the code must be applied both to the packaging or label of the set and to the packaging of each product inside the set.
• The code should not be printed on transparent wrapping film or other external wrapping material and overlapped with other information.
• If you are selling a set that cannot be disbanded, for example, bed linen, putting a code on the packaging is enough.

Step 4. Fill out the customs declaration

The customs clearance of shoes is regulated by the Decision of the Customs Union Commission of 20.05.2010 No. 257 «On the form of the declaration for goods and the procedure for filling it out».

Step 5. Enter codes into circulation

After the customs procedure for the release of shoes for domestic consumption, it is necessary to enter the codes into circulation before the shipment of the goods. This is a prerequisite in the chain of traceability between the participants of the turnover. Without entering into circulation, shoes are considered counterfeit.

Basic marking errors, penalties

The main mistake is an incorrectly designed label. To be sure that the data is filled in correctly, it is recommended to contact a specialized certification center. Deviations from generally accepted rules are not allowed in this case. The advantages of cooperation with a qualified contractor are speed and quality.

There are the following situations:

• the date of production of the drink is specified, but the date of its bottling is not specified;
• the information about the product is incorrectly or incompletely reflected, for example, the nutritional value of the imported sausage is not indicated;
• there is no data about the manufacturer, and this is a gross mistake;
• there is no data on the shelf life and at what temperature conditions to store products, which is especially important for food products, medicines and cosmetics;
• the marking was carried out without complying with the requirements of international regulations.

Manufacturers and sellers, selling unmarked shoes, violate Part 2 of Article 15.12 of the Administrative Code of the Russian Federation, may be criminally liable under Article 171.1 of the Criminal Code of the Russian Federation and must pay fines.

Administrative punishment for sale, warehousing, storage, transportation in this case can reach 300,000 rubles for companies and 10,000 rubles for sole proprietors. In case of incidents with labeling at the checkout, a fine of 5-10 thousand is possible (according to part 4 of Article 14.5 of the Administrative Code of the Russian Federation).

Criminal punishment. It is possible with damage in the amount of 1.5 million rubles, with the collusion of several persons. It provides for a fine of up to 500 thousand, mandatory work for a five-year term or imprisonment for 6 years can also be used as punishment.
